Not all field sobriety tests (FSTs) or chemical tests are accurate. In fact, some are notoriously inaccurate and all of them can be challenged. At the Rosenstein Law Group, we have in-depth knowledge of the science and legality of FST and BAC (blood alcohol content) testing.
Blood, urine and breath tests must be done according to strict protocols.
DUI defense attorney Craig Rosenstein is certified in administering Arizona breath tests and analyzing blood and urine tests. The more he knows, the better he can defend you against drunk driving charges.
- Arizona Breath tests must be properly administered by a certified officer using an accurately calibrated machine.
- Blood and urine samples must be properly taken by a qualified person, and the sample must be properly handled from the time they are taken and through the analysis process.
- Any mistakes in administering tests or handling and sample analysis are cause to have the evidence challenged.
Field sobriety tests are not required and are often inaccurate.
To be fully prepared as a defense lawyer, Craig Rosenstein is certified to administer FSTs, but he knows – as does the prosecutor – that FSTs are unreliable. You can politely refuse to take an FST. If you did, our experienced Arizona breath test attorney can challenge the results.
- The horizontal gaze nystagmus (HGN) test – or pen test – consists of tracking your eye movements while the officer moves a pen in front of your face.
- Balancing tests include standing on one leg for some time, doing a walk-and-turn, or touching your finger to your nose with your eyes closed.
- The officer may ask you to recite numbers or the alphabet backwards.
- In a dexterity test, the officer may ask that one finger at a time be closed into a fist.
Failing any of these tests may be due to weather, rough terrain, physical impairments, simple nervousness, medications or other causes – rather than intoxication.
