Because anyone can be pulled over on almost any pretext for suspicion of drunk driving, it is important to know your rights. Most people try to be helpful, talk to the police and do anything an officer asks. The officer, however, is looking only for evidence that justifies pulling you over.

  • You have the right to refuse certain field sobriety tests. FSTs are such exercises as walking a straight line, following a moving object with your eyes or balancing on one foot. They are not proven to accurately determine sobriety. (Your Arizona driver’s license does require you to submit to blood or breath tests.)
  • You have the right to an attorney. The moment you assert that right, the police must not ask you any more questions. DUI is a serious criminal charge. Make sure you call a lawyer. At the Rosenstein Law Group, you can call our Chandler AZ DUI attorneys any time of day or night.
  • You have the right to remain silent. You may feel you can talk your way out of the situation, but police will only be listening for incriminating evidence. Talk to your lawyer – and only to your lawyer – no matter how tempted you are to explain what happened.
